ZAMBIA : UPND vs ZNBC case dismissed

The Lusaka High Court has dismissed an application for Judicial Review by the UPND seeking to compel the Zambia National Broadcasting Corporation (ZNBC) to air their political adverts that the Corporation rejected.
The High court has also dismissed UPND’s application to stay ZNBC’s decision to rejects some of its adverts pending Judicial review.
High court Judge Pretronela Ngulube says the application lacked merit hence her decision to dismiss it with cost.
Justice Ngulube says the UPND should have explored avenues provided for by the Electoral Act before rushing to the High court.
In this matter ZNBC refused to air some of the UPND adverts because they did not meet the ethical criteria.
The opposition UPND argued that the rejection of its adverts had no legal basis hence the need for the court to help.
But ZNBC argued to the contrary urging the court to dismiss the application because UPND rushed to go to court without following procedure.
