ZAMBIA: High Court dismisses case against Maureen, UPND

LUSAKA High Court judge Mwila Chitabo has dismissed a case where UPND member Aaron Mulope sued the party, Maureen Mwanawana and others for allegedly blocking him from filing his nominations for mayoral elections in Lusaka.
Ruling on an application that Maureen should not be allowed to contest the mayoral elections on the UPND ticket because she did not take part in the adoption process, judge Chitabo dismissed the case, saying Mulope should have commenced the action by way of petition and not writ of summons and statement of claim.
“Having stated this, the issue of whether the proceedings before this court were statute barred was of no consequence as the matter already failed on the basis that the mode of commencement was irregular. In view of the above, I, therefore, allow the defendant’s application to raise a preliminary issue and consequently dismiss the plaintiff’s action before this court,” said judge Chitabo.
In this case, Mulope had also cited UPND secretary general Stephen Katuka, Chongwe UPND parliamentary candidate Sylvia Masebo and the Electoral Commission of Zambia.
