Kasungu First Grade Magistrate Court sitting at Kasungu on October 10, 2016 convicted and sentenced Patrick Tchuma, 38, to serve a 48 months jail term after being found guilty of Indecent Assault on a 26 year old woman.
Kasungu deputy spokesperson Harry Namwaza said the incident occurred at Kasankha area under Traditional Authority Kaomba in the district.
The court heard that, on July 3, 2016 Tchuma who is a neighbour to the complainant indecently assaulted a married woman to the extent of touching her breasts.
“On the material day, Tchuma also crossed the line by burging into the matrimonial bedroom of the complainant where he started uttering abusive languages on the complainant together with her husband saying the woman should be sleeping with him because he can satisfy her better that her husband who he described as impotent”, said Harry.
Tchuma was arrested on the same day and was charged with Indecent Assault which is contrary to Section 137 of the Penal Code.
The State through Prosecutor Inspector Griffin Luhanga of Kasungu Police Station bemoaned the behaviour of Tchuma which he described as morally unacceptable. Luhanga further told the court that the way Tchuma behaved on the woman needed a stiff punishment by considering also that the complainant is a married woman which Tchuma ought to have respected.
Before sentencing him, Kasungu First Grade Magistrate, His Worship Damiano Banda concurred with Luhanga and described Tchuma’s behaviour as morally daunting. Banda then sentenced Tchuma to 48 months jail term with hard labour.
Patrick Tchuma comes from Masada village in the area of Traditional Authority Masasa in Ntcheu district.
