Malawian Man jailed 12 Years For Defiling a 15 Year Old Girl.

In a bid to end defilement and rapes cases in Malawi, the Kasungu First Grade Magistrate Court on Wednesday, 25 May, 2016 convicted and sentenced Lucius Phiri, 21 years for defiling a 15 year old girl. 

The court heard that,  on May 13, 2016 Phiri defiled the victim in her own parents house in the village of Umphawi uwawa under Traditional Authority Mphomwa in the district.

On the material day, the victim was preparing to go to school and as she was coming from the bathroom to dress up,  she met the convict who told the victim that he wanted to initiate her hence, wanted to sleep with her. The victim refused but Phiri grabbed her and forced her into the house where he forcefully slept with her.

After Lucius had finished his act, the victim found a chance and shouted for help. This sent shudder in the suspect who started running away but he was apprehended by some community members who brought him to Kasungu Police Station. The victim was issued with a medical report to be medically examined and treated whose results were  tendered in evidence.

While in court, Phiri pleaded guilty as charged. Before passing sentence, the State through Sub Inspector Mariot Kamaliza, prosecutor based at Kasungu Kasungu Police Station requested the court to slap Phiri with a stiffer sentence because being a school going girl, the victim was psychologically traumatised which could affect her performance in school.

Kamaliza further bemoaned the increase in such cases in the district and argued that, slapping Phiri with a stiffer sentence would help deter the would be offenders on the same. When passing sentence, Kasungu First Grade Magistrate, His Worship, Damiano Banda concurred with the State by saying that people with Phiri’s behaviour are a threat to the society which should not go scot free. He then slapped Phiri with a 12 years jail term with hard labour.

Lucius Phiri hails from Magwalangwa village in the area of Traditional Authority Wimbe in Kasungu district.
