A barman identified as Symon Nyirenda has been sentenced to 12 years imprisonment on two counts of Defilement and Abduction by the Mzuzu Chief Resident Magistrate Texous Masoamphambe.
The convict, an 18 year old is Symon Nyirenda of Chimkusa village in the area of Traditional Authority (TA) Chindi in Mzimba district was a barman in one of the famous drinking joints in Mzuzu.
State Prosecutor, Cephas Chiumia told the Court that on May 19, this year, the convict met and took the 14 year old standard five girl to his house at Mchengautuwa where he made her his wife for one week.
The Court heard convict was locking up the girl in his house whenever he was going away.
The girl told the Court in her evidence that she found a chance to escape on May 26, 2016, after discovering that the convict had forgotten to lock the door when he was going to town.
At this time, her parents were busy searching for her in their relatives’ places but they couldn’t find her. This prompted them to report the matter to Mchengautuwa Police Unit. The officers referred the girl to the hospital where a medical report confirmed she was indeed defiled.
In Court, he answered two counts of Defilement and Abduction contrary to sections 138 and 135 of the Penal Code respectively.
The convict pleaded guilty and mitigated that he was looking after his younger brother therefore the court should be lenient when giving him judgement.
When passing judgement on 09th June 2016, the Magistrate imposed 12 years for the first count of Defilement and 3 years for the second count of Abduction. Both sentences to run concurrently.
