A magistrate Court in Karonga has convicted and sentenced a 49-year-old Flyson Minga to stay ten years in prison after finding him guity of defiling a ten-year-old girl at Mwandambo village in the district,contrary to section 138(1) of the penal code.
The court heard that on December 20, 2015 at Mwandambo village in the district, Minga had unlawful carnal knowledge of a girl under the age of sixteen without her consent.
Police prosecutor, Tamara Banda told the court that defilement is one of the serious offences in the country that attracts the maximum penalty of life imprisonment with hard labour.
Banda told the court that defilement cases are very common and are on the increase in the district as well as across the country, she added that the victim has suffered from trauma and she has been affected both physically and psychologically.
In mitigation, Minga asked the court to be lenient when passing sentence on him because he has got a very big family responsibility.
However, delivering the sentence First Grade Magistrate Chakaka Nyirenda concurred with the state about the seriousness of the offence.
He then said that the accused person is the first offender, and he therefore sentenced Minga to stay ten years in prison with effect from the date of arrest.
Minga hails from Mwandambo village in the area of Traditional Authority (T/A)Mwakawoko in Karonga district.
