On Wedenesday, February 15, 2017, the Magistrate Court sitting at Chintheche in Nkhata Bay convicted and sentenced Julius Phiri to 14 years imprisonment with hard labour for the offence of defilement which is contrary to section 138 of the penal code.
Sergeant Pachalo Nyirenda, a prosecutor based at Chintheche police post told the court that on February 8 2017, the accused person defiled a 3 year old girl at Chintheche trading centre.
The prosecutor further told the court that the suspect got arrested after the mother to the victim found the suspect red handedly in the act and was arrested by welwishers.
When he appeared before court, he pleaded guilty to the charge levelled against him and during mitigations, he told the court that he looks after his family including his elder grand mother therefore if sent to prison, his family will suffer most.
Passing sentence, First Grade Magistrate Alexander Gomba agreed with the prosecution that the convict deserved a custodial sentence bearing in mind that the victim is not only so young but also that the young girl has psychologically, mentally and physically been affected. The convict was later handed a 14 years jail term by the presiding magistrate.
The 40 year old convict, Julius Phiri hails from Ngalauka village in the area of Traditional Authority ( TA ) Malanda in Nkhata Bay distirict.
